A small, ageing Greek Cypriot community stayed there after the 1974 Turkish invasion, which began an illegal occupation that continues today.

In its ruling of 10 May 2001 in Cyprus v Turkey (application 25781/94), the European Court of Human Rights found that the enclaved Greek Cypriots suffered discrimination amounting to degrading treatment. It held Turkey responsible.

Why the court held Turkey responsible

Ankara argued that the issues fell solely under the local Turkish Cypriot authorities. The court rejected this.

Because Turkey exercises “effective overall control” over the occupied areas, its responsibility covers its own soldiers and officials. It also covers the local administration that survives on Turkish military and other support.

According to figures the Republic of Cyprus gave the court, about 20,000 Greek Cypriots lived in Karpasia in 1974, but only 429 remained. These were Cypriot government figures, not a census.

The judges found that the enclaved Greek Cypriots faced monitoring of their contacts and movements. Residents had to justify even routine trips outside their villages, and officials were present in homes during social visits.

For the enclaved Greek Cypriots, the court also found a violation of religious freedom and no adequate secondary schooling. Primary school books faced excessive censorship.

The community’s property was not protected if residents left for good. Relatives in the free areas could not inherit it.

The judges said the interference targeted them “precisely because they belonged to this class of persons”, and called their conditions “degrading”. Most findings passed by 16 votes to one.

What the UN says about enclaved Greek Cypriots now

The UN secretary-general’s latest report on UNFICYP (S/2026/8, 5 January 2026) covers 12 June to 15 December 2025.

During that period, peacekeepers delivered basic supplies to 283 Greek Cypriots and 45 Maronites in the occupied areas. The mission also monitored 20 court hearings, including those of five Greek Cypriots arrested there on 19 July 2025.

Turkish Cypriot authorities approved 28 of 57 requests for religious services passed through UNFICYP. Still, they approved all seven Greek Cypriot teachers for Rizokarpaso schools for 2025/26.

However, the same side judged that 37 of 97 primary and 54 of 191 secondary textbooks contained “inflammatory language”. That view is theirs alone and does not cancel the 2001 finding of excessive censorship.

For the enclaved Greek Cypriots, the ruling remains a legal record of what occupation meant for those who stayed. Cyprus, the EU and the UN cite it against the status quo. That case continues decades after the second phase of the invasion, as displaced Cypriots still wish to return.

 Tags:
Athens, Cyprus, Cyprus Problem, Cyprus v Turkey, ECHR, enclaved Greek Cypriots, European Court of Human Rights, Greece, Greece news, Greek news, greek news now, greek news on demand, greek news today, human rights, illegal occupation, Karpasia, Maronites, Rizokarpaso, Turkey, Turkish invasion 1974, UNFICYP

Athens Bureau

Athens Bureau is Greek City Times’ news desk in Athens, reporting on Greek politics, society, economy, culture, and breaking national news for readers in Greece and the diaspora.

Source link

Europe’s top human rights court found that Turkey subjected the enclaved Greek Cypriots of Karpasia to degrading treatment, and a new UN report shows they still depend on aid.
